Terms of Use

These terms govern your use of the Elle Santé mobile application and web portal (the “Service”), operated by Elle Santé Inc. By creating an account or using the Service you agree to them. If you do not agree, do not use the Service.
1. What the Service is — and what it is not
Elle Santé helps you find and book care, complete intake questionnaires, communicate with your clinic, and keep track of your own health.
Elle Santé does not provide medical advice, diagnosis or treatment. Care is provided by the clinic and the licensed clinicians you book with. They are responsible for their clinical judgement; we are responsible for the software.
The Service is not for emergencies. If you are having a medical emergency, call 911 or go to your nearest emergency department. Do not use the app to report an urgent problem — messages are not monitored continuously.
Any general health information in the app is for education only. It is not a substitute for advice from a qualified professional who knows your situation.
2. Eligibility and your account
You must be 18 or older, or use the Service with a parent or guardian, or be a minor whom provincial law permits to consent to their own care.
Give us accurate information and keep it current — clinical decisions may be made on the basis of what you tell us. Keep your credentials to yourself; you are responsible for what happens under your account. Tell us promptly if you think someone else has access.
3. Appointments, cancellations and fees
- Booking a slot requests it. Depending on the clinic, it may be confirmed automatically or held until the clinic confirms.
- Each clinic sets its own cancellation policy, including how much notice is required and any late-cancellation or missed-appointment fee. The applicable policy is shown to you before you confirm.
- If you cannot attend, cancel as early as the clinic’s policy allows. Fees for late cancellation or non-attendance are charged by the clinic, not by us.
- A clinic may need to reschedule. We will tell you as soon as we know.
4. Payments
Payments are processed by Stripe. Your card details go directly to Stripe and are never stored on our systems. You authorise the clinic to charge the payment method you provide for services you receive and for fees under the clinic’s cancellation policy.
Fees for care are set by the clinic. Refunds are a matter between you and the clinic and follow its policy. Where a payment fails, the clinic may ask you to settle it another way.
5. Acceptable use
Do not use the Service to break the law, impersonate anyone, harass a clinician or another patient, upload malicious code, scrape or reverse engineer it, or attempt to reach information that is not yours. Do not book appointments in bad faith. We may suspend or close an account that does these things.
6. Your content
What you record stays yours. You give us the permission we need to store, display and transmit it in order to run the Service and to make it available to the clinicians you have chosen. That permission ends when you delete the content or your account, except where we are required to retain a clinical or billing record (see the Privacy Policy).
7. Our content
The Service, its software, design and text are owned by Elle Santé or its licensors. You may use it for its intended purpose. You may not copy, resell, or create derivative works from it without our written permission.
8. Availability
We aim to keep the Service available but do not guarantee uninterrupted access. We may suspend it for maintenance, and we may change or discontinue features. Where a change materially reduces what you get, we will give reasonable notice.
9. Disclaimers and limits
Except as this section says, the Service is provided “as is” without warranties of any kind, to the fullest extent the law allows.
To the extent permitted by law, Elle Santé is not liable for indirect, incidental or consequential loss, and our total liability for any claim relating to the Service is limited to the amount you paid us for it in the twelve months before the claim.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Nothing here limits the professional or legal responsibility of a clinic or clinician for the care they provide, and nothing here removes rights you have under consumer protection legislation, including the Québec Consumer Protection Act.
10. Indemnity
You agree to indemnify Elle Santé against claims arising from your misuse of the Service or your breach of these terms. This does not apply to the extent the claim arises from our own act or omission.
11. Ending your use
You may stop using the Service and delete your account at any time in Settings › Account. We may suspend or close an account for a serious or repeated breach of these terms, or where we must do so by law. Retention of clinical records after closure is governed by the Privacy Policy.
12. Changes to these terms
We may update these terms. If a change materially affects your rights we will notify you in the app before it takes effect. Continuing to use the Service after that constitutes acceptance. Every version carries a version number and an effective date.
13. Governing law
These terms are governed by the laws of the Province of Québec and the federal laws of Canada that apply there. The courts of the district of Montréal have jurisdiction, without affecting any right you have to bring proceedings where you live.
14. Language
These terms are available in French and in English. The French version prevails in Québec. Les parties confirment leur volonté que ce document soit rédigé en français et en anglais.
